The types of personally identifiable information that may be collected at these pages include: name, address, email address, telephone number, fax number, credit card information, and information about your interests in and use of various products, programs, and services.

In order to use some features of this website, a user must first complete the registration form. We also may use this information in the aggregate to analyse site usage, as well as to offer you products, programs, or services.

Although we take appropriate measures to safeguard against unauthorised disclosures of information, we cannot assure you that personally identifiable information that we collect will never be disclosed in a manner that is inconsistent with this Privacy Notice.

We may on occasion combine information we receive online with outside records to enhance our ability to market to you those products or services that may be of interest to you. DriveMyCar Rentals may revise this Agreement at any time by updating it. You should visit this page periodically to review this Agreement, because they are binding on you.

GENERAL PROVISIONS: The material that appears on www.DriveMyCarRentals.com.au is for informational purposes only. Despite our efforts to provide useful and accurate information, errors may appear from time to time. Before conducting any Vehicle leasing you should confirm any and all information regarding the Owner and/or Driver (including, where the rental of a Vehicle, the monthly rental payments, inception fees, lease term, insurance, excess Km charge, total allowed kilometres) that is important to your decision. DriveMyCar Rentals is not responsible for, and does not guarantee the performance of, any such goods or services or information.

The DriveMyCar Rentals rental process requires each party (Owner and Driver) to provide information essential to the rental. Such information may include an individual or company's name, address, phone number, email address, Vehicle's description details, and other information ("User Information").

The DriveMyCar Rentals Website accepts the User Information supplied by various Users, and assumes no responsibility for verifying the accuracy of such User Information, and does not endorse or approve of any Vehicle, Owner or Driver. The User Information is used by DriveMyCar Rentals to allow the Owner and prospective Driver to contact each other so as to facilitate the lease-out process.

DriveMyCar Rentals services are available to individuals and business. Individuals agreeing to be bound by this Visitor Agreement on behalf of a business must be an officer or agent of such business who is authorised to form legally binding contracts on behalf of the enterprise under applicable law. And any such person hereby certifies that is an officer or agent of such business.

DriveMyCar Rentals may also refuse to provide the Services to anyone or any entity at any time, in our sole discretion and DriveMyCar Rentals reserves the right to deny use of this service to anyone who uses the service in manner we consider inappropriate.

DriveMyCar Rentals does not endorse the accuracy of any message transmitted through the Interactive Messaging System. Please use your best judgment and be respectful to other individuals using this forum. Do not use vulgar, abusive, or hateful language.

You may not use the Interactive Messaging System for advertising or promotional materials or other forms of solicitation not related to the applicable Listing.
Given the nature of the service and the volume of messages and listings, DriveMyCar Rentals cannot monitor all messages transmitted though the Interactive Messaging System. However, please contact DriveMyCar Rentals customer service if you encounter any communication that is obscene, defamatory, or otherwise unacceptable.

DriveMyCar Rentals reserves the right to delete, move, or edit any communication that it deems in its sole discretion to be a violation of this Agreement or defamatory or insulting in any way.

VEHICLE LISTINGS: DriveMyCar Rentals does not review Vehicle listings posted on www.DriveMyCarRentals.com.au. You can expect these areas to include information and opinions from a variety of individuals and organisations other than DriveMyCar Rentals. We do not endorse or guarantee the accuracy of any listing. Responsibility for what is listed in www.DriveMyCarRentals.com.au lies with each user.

You alone are responsible for material you post. By using www.DriveMyCarRentals.com.au you agree not to post or transmit any defamatory, abusive, obscene, threatening, misleading, or illegal material, or any other material that infringes on the rights of others or interferes with the ability of others to enjoy www.DriveMyCarRentals.com.au.

We retain the right to deny access to anyone who we believe has violated these terms or any other term of this Agreement. You will not use the service to violate the copyright, trademark, or other intellectual property rights of any person or other entity. By submitting material to www.DriveMyCarRentals.com.au, you are representing that you are the Owner of the material, or are making your submission with the explicit consent of the Owner.

OWNERSHIP OF LISTINGS AND COPYRIGHTS: You hereby grant DriveMyCar Rentals a non-exclusive license to publish all listings you provide us. DriveMyCar Rentals is not responsible for any damage or loss to any listings, copy, drawings, and art or any other materials you provide. You herby agree that by placing a listing on www.DriveMyCarRentals.com.au, you hereby grant a license to DriveMyCar Rentals on a non-exclusive basis, all copyrights and other ownership rights in the listing, including the right to publish, reproduce, display, adapt, transmit, or produce derivative works in any medium, including any digital electronic medium.

 

Registration

To obtain access to certain DriveMyCar Rentals services you will be given an opportunity to register on the site. As part of the registration process, you will be required to enter a valid email address and a password. You agree that the information you supply during that registration process will be accurate and complete and that you will not (i) register under the name of, nor attempt to enter the service under the name of, another person; nor will you (ii) adopt a user name that DriveMyCar Rentals, in its sole discretion, deems offensive. You will be responsible for preserving the confidentiality of your password and will notify DriveMyCar Rentals of any known or suspected unauthorised use of your account. You agree to receive notification via email, SMS and telephone in relation to a Vehicle rental.

 

Applicant Transaction Fees

DriveMyCar Rentals may charge Owners a $25 (plus GST) non-refundable listing fee when a Vehicle is advertised on www.DriveMyCarRentals.com.au website.

 

Rates

DriveMyCar Rentals reserves the right to revise rates, terms and specifications contained in the current listing rates.

 

Payments

We accept Visa®, MasterCard® credit card payments only. Please be sure to provide the exact billing address and telephone number that your credit card issuer has on file for you. Incorrect information may cause a delay in the processing.

 

Excess

If the Driver chooses to pay the Insurance Excess Wavier, the excess payable will be reduced by 50%.

 

Listing, Advertising and Promoting Fees

All processed and billed listing, advertising and promotion fees are non-refundable.

 

Booking and Cancellation Policy

Bookings are confirmed when an Owner accepts a booking request via SMS or www.DriveMyCarRentals.com.au and the Driver's booking deposit is authorised in the payment gateway. All booking deposits are non-refundable.

The commencement of a booking is the time that is 24 hours prior to the nominated or agreed Vehicle drop off time. Either the Driver or the Owner may cancel a booking at any time prior to the commencement of a booking subject to a cancellation penalty payable to DMCR. If the Owner is the cancelling party he or she must pay a cancellation fee of $125 (plus GST). If the Driver is the cancelling party, he or she will forfeit to DMCR their booking deposit.

Either the Driver or Owner may cancel a booking at any time after the commencement of a booking subject to a cancellation penalty. If the Driver is the cancelling party, he or she will pay to DMCR a cancellation penalty of 30% of the outstanding rental amount. DMCR will forward to the Owner the cancellation penalty minus insurance fees of 30% of the remaining rental period which covers the expenses for DMCR to find a replacement Driver.

If the Owner is the cancelling party DMCR will charge a cancellation penalty of $600 (plus GST) to find a suitable replacement Vehicle. The Driver will be entitled to keep the Vehicle until such time DMCR has found a replacement Vehicle.

The party responsible for any early cancellation is liable for the payment of any reasonable costs incurred in returning the Vehicle to the Owner.

If a Vehicle is rendered unusable for any reason that results in early cancellation then the party deemed responsible will be held accountable for early cancellation fees and associated charges.

 

Responsibility of DriveMyCar Rentals

DriveMyCar Rentals shall display the listings submitted by you on www.DriveMyCarRentals.com.au subject to your listing remaining in good standing. Your listings will be placed in the site's listing database, which may be accessed by visitors to the Site. DriveMyCar Rentals reserves the right to reject and/or remove any listing submitted by you for any reason.

Special positions for your listing(s) are not guaranteed. However, some special positions may be available for a premium. Posting a Vehicle for rental does not guarantee in any way that you will be successful in obtaining a successful rental agreement for your Vehicle.

 

Important Lease Information

Any outstanding lease payment and associated fees or charges that occur during the lease-out period are the responsibility of the Owner and Driver. DriveMyCar Rentals is not responsible for any default payment that may occur between the Owner and Driver. However, for a fee, DriveMyCar Rentals may assist individual parties in recovering outstanding payments, fees or charges.

 

Important Obligations

You guarantee that any listing you submit is truthful and in compliance with all copyright laws and all other applicable laws and regulations. You guarantee that you shall conduct yourself ethically in the use of the Site and in any transaction resulting from said use.

 

Insurance Cover

For an insurance claim to be made, the Owner and Driver must have a valid rental agreement. A rental agreement is NOT valid if the Driver and the Owner enter into any private rental agreement in-conjunction with the DMCR rental agreement provided.

The insurance cover may not be valid if the Driver falls behind in the payment of insurance fees.

Both the Owner and Driver are urged to review the compulsory third party insurance (CTP) policy applicable to the Owner’s Vehicle to ensure that it is appropriate. Due to legislative requirements in some Australian States and Territories, the Owner may be required to have "commercial" CTP cover as opposed to "private" CTP cover prior to entering into an Agreement for the Use of Motor Vehicle with a Driver. If the Owner is required to obtain commercial CTP cover, the increase of price from private CTP cover is relatively minor and should not exceed $200. DMCR accepts no liability whatsoever where an insurance claim is denied by a CTP insurer on the basis that the Owner of a Vehicle listed on this website has not obtained appropriate CTP cover.

 

Credit Cards and Liability

At the time the Agreement for Use of a Motor Vehicle is entered into between a Driver and an Owner, DMCR will obtain credit card details from the Driver for the payment of fees and charges in accordance with the Agreement for Use of a Motor Vehicle. Owners should be aware that while DMCR will use all reasonable care to ensure credit cards remain valid at all times during a rental period between an Owner and Driver, DMCR cannot be held liable for the nonpayment of any fees and charges that are payable to the Owner in the event that the Driver’s credit card is cancelled, has reached its maximum credit limit or is otherwise not chargeable.

 

Enforcement Proceedings

DMCR acts as agent for the Owner and therefore cannot commence enforcement proceedings against a Driver on behalf of an Owner. Situations may from time to time occur where the Driver does not pay any fees or charges that he or she is liable for. For example a Driver may refuse to pay some part of the rental charge, an infringement notice incurred when the Driver was either driving or in control of the vehicle or the insurance excess that is due and payable and the Driver’s credit card is not chargeable. DMCR, as agent for the Owner, will undertake all reasonable steps to recover any fees and charges payable by the Driver from the Driver direct. If these reasonable steps are unsuccessful the Owner has the election to commence enforcement proceedings. In instances where an Owner makes an election to commence enforcement proceedings against a Driver DMCR will provide all reasonable assistance to the Owner in the recovery of outstanding fees and charges from a Driver. DMCR will not be liable to the Owner for the payment of these fees or charges or for any legal fees incurred in the recovery of these fees and charges by an Owner against a Driver.

IF YOU RELY ON THIS SERVICE OR ANY MATERIAL AVAILABLE THROUGH THIS SERVICE, YOU DO SO AT YOUR OWN RISK.

YOU UNDERSTAND THAT THERE MAY BE DELAYS, OMISSIONS, INTERRUPTIONS, INACCURACIES, AND/OR OTHER PROBLEMS WITH THE INFORMATION, PRODUCTS, AND SERVICES PUBLISHED OVER THIS SITE.

THIS SERVICE IS PROVIDED TO YOU "AS IS." DRIVEMYCAR RENTALS AND ITS AFFILIATES, AGENTS AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NONINFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE INFORMATION AVAILABLE THROUGH THE SERVICE (OR ANY INFORMATION, GOODS OR SERVICES THAT ARE REFERRED TO, ADVERTISED ON, OR SOLD THROUGH THIS SERVICE). NOR DO THEY GUARANTEE THAT THE SERVICE WILL BE ERROR FREE, OR CONTINUOUSLY AVAILABLE, OR THAT THE SERVICE WILL BE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT DRIVEMYCAR RENTALS AND ITS AFFILIATES, AGENTS AND LICENSORS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICE; (iii) UNAUTHORISED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.

YOU AGREE THAT THE LIABILITY OF DRIVEMYCAR RENTALS AND ITS AFFILIATES, AGENTS AND LICENSORS, IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM IN ANY WAY ARISING OUT OF OR OTHERWISE RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, TO THE SERVICE FOR USE OF THE SERVICE.

 

Miscellaneous

No spamming. You agree not to gather any email addresses through DriveMyCar Rentals for purposes of spamming. By submitting material to DriveMyCar Rentals you are permanently granting DriveMyCar Rentals all rights to the material, including the right to modify the material, to use it commercially, and to maintain the material in an archive. I certify that I am an adult (18 years old or older) have read the Visitor Agreement, accept all of its terms and conditions and can enter into this Agreement.
